No you should not. You need to either 1. buy air tight insulated housing (this is typically brand specific); 2. buy insulated housing (if not air tight) put on a insulated boot (this is typically generic).

If you have access to attic, get this. Very quality light for about 21 each, including the insulated box. But you still need the boot though. But if you are not applying for a permit, I think it is safe to skip the boot.

I think the key is whether the housing of your light come in contact with the insulated material. Even in your second cases, if inside the vaulted ceiling there aren't dryway and it contains insulated material, you still face the same problem.Some people even put insulation (for sound proofing purpose) on first floor then it is subject the same requirement.
