Your post is very helpful. I have some questions.

I am working for a company thru an employment agent placement. I work in the client site Monday to Friday. On the first business date of every month, I print out a time sheet, get my boss (at the client site where I am working) signed it, send this time sheet together with an invoice (hour rate * hours) to the agent. They will pay me the lump sum wage, with CPP and EI deducted.

The portion of the deducted CPP and EI is about 6% of my total wage.

In the contract I signed with the agent, I am defined as self-employed. I registered a GST number in the beginning of year 2002, and collected 7% GST since January 2002.

So my question is:
1. I am paying the EI premium. Am I eligible to collect EI in case my contract didn't renew? ( I have worked one year.)
2. Is there any expense I can deduct when file the tax return?

    • You need to ask your employer the status of your employment. Whether it is contract job or partime employment.
      If it is contract job, and the employer pay you a lump sum wage that includes everything, like what you have got, the nature of your employment is like self-employed. You report your income at year end. You can deduct your business expenses from your income. You have to pay your share of CPP (Canadian Pension Plan contribution). It is optional to pay EI. If you pay EI, you can enjoy EI benefit. There is a form with guide at Canada Custom & Revenue Agency (CCRA) called "Statement of Professional Activities". Go find the guide and read it.

      If it is employment nature. Your employer MUST WITHHOLD your CPP contribution, EI premium, and your estimated income tax from each pay and submit them to CCRA every month. Your employer also has to contribute CPP for you, pay 140% of EI you pay, plus Workplace Safety Insurance for you. It is illegal to just give you wage but contribute nothing of CPP, EI, and WISB for you.

      That might be the reason that some employers are reluctant to hire people as employees.

        • 1. Yes. 2. Yes
          EI is Unemployment Insurance Premium. If you paid insurance premium of any kind, you are entitled to make a claim when such event occurs. Check with your local CCRA office to make certain that you are eligible, otherwise, claim back the EI premium you have paid.

          The guide for <The Statement of Professional Activities> from CCRA lists details of what you can deduct as your expenses that are directly related to your professional activities. For example, you can deduct travel, accounting, legal, entertainment, motor vehicle, office expenses, rental, bank charges, equipment depreciation..... many many. Every item has to be spent for your work. In case you can not separate your personal use and business use, you are allowed to make fair estimate of the proportion that is used for your business. Only this portion can be deducted. If you feel overwelming to handle it your own, find an accountant to help you. The cost is about $50-$100. Next time, you just follow the example to do it yourself.

            Yes, I drove my car to work, but that's it. It's not like driving to visit customer. If only for commute between office and home, can the car related expense be tax deductable?

            Also, the client provides all the equipement for work, including computer, stationary, office. So, is my rent or mortgage tax deductable?

            I remembered I read it somewhere that I don't have to remit all the GST I collected. There is a percentage I can keep and treat it as my income. But I couldn't find such info on CCRA web site. Any hint?

              Yes. Example: for your car, you have paid license fee, insurance, repairs, parking, gas, car wash, etc. And total mileage for the year is 20k among which you estimate driving back and forth to work place was about 10k. Add all the costs together, claim 50% as business expenses. You are required to keep all the receipts for 6 years. CCRA has right to review your claim at any time during this 6 year period. I prefer to use credit card for everything. At the end of each month, I tick all business related items on the monthly statement as my record.

              If not work at home, you can not claim home office expenses because there is no home office. If you do, same as car example, estimate the percentage of that office room over total square foot of your house and claim that percentage of total housing costs as business expenses. Some other expenses you can claim are long distance phone bill, fax machine use, internet access fee. Again, anything related to your business activities.
