Regarding your employment benefit. Whether your employer pays CPP and EI for you or not will not affect your eligibility of claim and the amount you are entitled. If you are an employee, payroll regulation requires both you and your employer to contribute for you. The exact amount varies over time.

In last year's example of CPP contribution, no contribution for the first $3500 you make, you contribute 3.5% of your gross income (the amount over $3500) to CPP. Your employer's share is the same as yours.

For EI, you shall pay approximately 1.3% of your gross income as EI premium. Your employer's portion is 1.4 times of yours.

That indian also is supposed to pay Worker's Safety Insurance for you. The rate varies with the type of job you are performing. You pay nothing on this one.

To conclude, you do not have to fear that your employer might give you a bad reference if you can have it from someone else. You need to make clear about your current employment status with your employer and ask him to put it on paper and sign it. The best source for these type of questions is to ask CCRA directly. Find a CCRA local office and pay them a visit.

    本文发表在 rolia.net 枫下论坛还说他是DO ME A FAVOR.前几周终于忍不住将在政府网站上查到的资料给他,让他知道这是法律规定的一定要给雇员买EI,CPP,他就老羞成怒,说那好,你就去APPEAL,如果政府说一定要交我就交,政府说可以不交的钱我一分都不会交.然后他就咬住当初开面谈时说他提过让我做SELFEMPLOYEE,我口头答应过(当时我根本不懂什么是SELFEMPLOEE,什么是EMPLOYEE),作文章.
    他当时给我的条件是三个月内每小时12元,三个月后年薪三万,但后来九个月了一份钱不给长,我们之间也从未签过任何CONTRACT,每次工资都是他给一张CHEQUE(只按小时算好工钱),没有STATMENT.
    从政府的网上得知,SELFEMPLOYEE和EMPLOYEE如果没有合同规定,是可以通过工作形式等等界定的,按上面的说明,我目前从事的工作形式100%应算EMPLOYEE,所以如果向政府反应的话是有把握的.
    问题是我即将有一个面试,是一种由CONSULTING公司派到其它公司工作的性质,CONSULTING公司的面试已通过,就看这一次面试了.因此我不敢和目前的老板搞得太疆,怕到时如果人家要REFERENCE,他不负责地说话(鉴于他的人品).本来我一个月前就跟他说不干了,可他还拖着,暂时也没合适的人接替,就一直还帮他干着,现在他说只能帮我从10月起买EI,前面的半年就算CONTRACT.

      • 非常感谢详尽的回答!!但因实在再也不想呆下去了,所以前两周就跟他打招呼要走人了,下周起就基本不用回公司了,但他到现在什么也没弄好,只愿从10月开始帮我交EI,之前的要我跟他签合同当作自雇.请问CCRA是什么?
        因怕搞太疆,看来好象没什么办法只好吃哑巴亏.公司一直就老板和我两人,上月才来了个新的,还是VOLUNTEER.所以也找不到同事给我REFERENCE

          第一,他给你的工资是支票吧?他想赖都不成。第二,他不给你上EI,是严重违法的行为,第三,你还怕他不给你钱吗?打电话,911。另外,你这样正好可以让警察帮你把Reference办了。嘿嘿,哥们儿,加拿大可不是一个可以欺负人的地方。
          • 铁马兄说的是,但又怕时间折腾不起,我马上要面试了.再说以前试过找LEGAL AID帮追讨一华人雇主欠的200元工钱都弄了三个月.不知现在找政府APEAL投诉要折腾多久?有无有经验的DX知道的?
            • 另外,因为他不给交EI能打字911吗?工钱倒是按时给的,就是不想给我办10月份以前半年的EI,CPP,估计也没帮我买什么WORK SAFTY INSURANCE,签应帮交10月以后3个月的EI,但要我签个证明前半年是SELFEMPLOYEE的PAPER,担心签完有什么麻烦没有?
